Terms and Conditions
Version applicable from June 15, 2026
1. Purpose
BlaBlaCar operates a global travel platform, accessible via a website (blablacar.com and its local extensions) and mobile applications (the “Platform”), which allows users to post carpooling trips or to search for, compare, book and purchase a range of transport services, such as carpooling, bus and train.
The Platform is designed to: (i) put drivers travelling to a given destination on their own account in touch with passengers travelling in the same direction, in order to allow them to share the trip and the associated costs (carpooling); (ii) enable users to search for and purchase Bus Tickets from third-party transport operators (the “Bus Operators”); and (iii) enable users to search for and purchase Train Tickets from third-party rail operators (the “Rail Operators”) whose offers we distribute.
The purpose of these Terms and Conditions is to govern the access and conditions of use of the Platform. We invite you to read them carefully. You understand and acknowledge that BlaBlaCar is not party to any agreement, contract or contractual relationship of any nature whatsoever entered into between the Members of its Platform or with a Bus Operator or Rail Operator.
By clicking on the “Continue with Facebook” or “Continue with an email address” button, or on “Continue with Apple” for connections via the iOS App, or by clicking on the “Confirm and Pay” button, you acknowledge that you (i) have read and (ii) accept all the present T&Cs in full. The T&Cs, the Privacy Policy, and the statutory rules and regulations of the country of the platform on which you make your Booking, or on which you post your Advert as a Driver, shall apply.
(Only applicable in Ukraine) By so doing, you also understand that, in accordance with the laws of Ukraine, your acceptance of these Terms of Use means the conclusion of an electronic contract between BlaBlaCar and you.
Please note that the country of Booking and the country of the Trip may be different. Some conditions described in these T&Cs apply only if the corresponding features are offered in the country of Booking or the Trip (as indicated in the Booking or Posting process).
| BlaBlaCar is a global platform, but the services offered (carpooling, bus, train) and options (such as the application of the Service Fee and online payment) may vary depending on the country or the Platform that you use. Depending on where you post your advert or make your Booking, some features described in these conditions may therefore not be available, or may apply differently, as specified in the T&Cs or on the Platform. Likewise, mentions indicated as “only applicable” to a specific country only concern users or trips related to that country, to the exclusion of all others. |
2. Definitions
In this document:
“Advert” means, without distinction, a Carpooling Advert, a Bus Advert or a Train Advert;
“Carpooling Advert” means an advert concerning a Trip posted on the Platform by a Driver;
“Bus Advert” means an advert concerning a Bus Trip operated by a Bus Operator and posted on the Platform;
“Train Advert” means an advert concerning a Train Trip operated by a Rail Operator and distributed on the Platform;
“Bus Operator” means a professional passenger transport company whose Bus Trips are distributed on the Platform;
“Ticket” means the nominative valid transport title delivered to the Customer, following the Order for a Bus or Train Trip, constituting proof of the existence of a contract of carriage between the Passenger and the Bus Operator or the Rail Operator, which contract is governed by the T&Cs of Sale, without prejudice to any additional particular conditions stipulated between the Passenger and the Bus Operator or the Rail Operator and referred to on the Ticket;
“BlaBlaCar” means the company Comuto SA (as described in Article 17 “Legal notices”), which acts as publisher of the Platform. By derogation from the above, where the User accesses the Services through the platforms of the countries listed below, the term “BlaBlaCar” means the corresponding local entity:
- Brazil: Comuto Serviços de Tecnologia Ltda.
- Mexico: BlaBlaCar Mexico S.A de C.V.
- Ukraine: LLC “I-Travels”.
- Poland: Busfor.pl Sp. z o.o for the part relating to Bus Ticket Bookings.
“Help Centre” means BlaBlaCar’s information and documentation base made available to Members and/or Passengers, accessible via a link available in Article 16;
“T&Cs” means these Terms;
“T&Cs of Sale” or “Bus Operators T&Cs of Sale” means the General Terms and Conditions of Sale of Transport of the Bus Operator concerned (accessible in the margin, on the right-hand side of these T&Cs or via this link https://legal.blablacar.com/) depending on the Bus Trip selected by the Customer, and the particular applicable provisions as indicated on the Platform, which the Customer acknowledges having read and accepted when placing their Order;
“Train T&Cs of Sale” means the General Terms and Conditions of Sale of Transport of the Rail Operator concerned (accessible in the margin, on the right-hand side of these T&Cs, or via this link https://legal.blablacar.com/) depending on the Train Trip selected by the Customer, and the particular applicable provisions as indicated on the Platform, which the Customer acknowledges having read and accepted before placing their Order;
“Customer” means any natural person (Member or not) who has purchased, either for their own account or on behalf of a third party who will be the Passenger, a Bus Ticket or a Train Ticket through the Platform in order to make a Trip operated by the Bus Operator or the Rail Operator;
“Order” means the operation by which the Customer reserves any Transport Services with BlaBlaCar, regardless of the means of reservation used, except in the case of purchase at a Point of Sale, and which entails for the Customer the obligation to pay the Price relating to the Transport Services concerned;
“User Account” means the account that must be created in order to become a Member and access certain Services offered by the Platform;
“Apple Connect Account” has the meaning given to it in Article 3.2 below;
“Facebook Account” has the meaning given to it in Article 3.2 below;
“Driver” means the Member who offers, on the Platform, to transport another natural person in exchange for the Cost Contribution, for a trip and time defined solely by them;
“Booking Confirmation” has the meaning given to it in Article 4.2.1 below;
“Member Content” has the meaning given to it in Article 11.2 below;
“Rail Operator” means a professional passenger transport company whose Train Trips are distributed on the Platform;
“Contact Form” is the form made available to Members and/or Passengers to communicate with BlaBlaCar; this form is available via a link indicated in Article 16;
“Service Fee” has the meaning given to it in Article 5.1.2 below;
“Subscription Fee” has the meaning given to it in Article 5.1.2.3 below;
“Member” means any natural person who has created an Account on the Platform;
“Passenger” means (i) the Member who has accepted the offer to be transported by the Driver or, as the case may be, the person on whose behalf a Member has booked a Seat, or (ii) the Customer who has purchased a Ticket from the Bus Operator or the Rail Operator or, as the case may be, the person on whose behalf a Customer has purchased a Ticket from the Bus Operator or the Rail Operator;
“Cost Contribution” means, for a given Carpooling Trip, the sum of money requested by the Driver and accepted by the Passenger as their contribution to the travel costs;
“Seat” means the seat booked by a Customer on board the Driver’s vehicle or on board a vehicle operated by a Bus Operator or on board a Train;
“Platform” has the meaning given to it in Article 1 above;
“Booking Platform” means the BlaBlaCar Platform on which the Member makes a Booking;
“Point of Sale” means the physical counters or terminals at which Tickets may be offered for sale;
“Privacy Policy” means the rules for protection of your personal data and your private life, the link to which is accessible in the margin, on the right-hand side of these T&Cs or via this link https://legal.blablacar.com/;
“Transport Services” means the transport service(s) subscribed to by the Passenger of a Bus or Train Trip and provided by the Bus Operator or the Rail Operator;
“Price” means, for a given Bus Trip or Train Trip, the price including all taxes, charges and related service costs, paid by the Customer on the Platform, at the time of validation of the Order, for a Seat on a given Bus Trip or Train Trip;
“Booking” has the meaning given to it in Article 4.2.1 below;
“Services” means all the services provided by BlaBlaCar through the Platform;
“Leg” has the meaning given to it in Article 4.1 below;
“Additional Payment” has the meaning given to it in Article 4.4 below;
“Trip” means, without distinction, a Carpooling Trip, a Bus Trip or a Train Trip;
“Carpooling Trip” means the trip which is the subject of a Carpooling Advert posted by a Driver on the Platform and for which they agree to transport Passengers in exchange for the Cost Contribution;
“Bus Trip” means the trip which is the subject of a Bus Advert on the Platform and for which a Bus Operator offers seats on board the vehicle in exchange for the Price;
“Train Trip” means the trip which is the subject of a Train Advert on the Platform and for which BlaBlaCar offers seats;
“Hyperwallet Payment Solution” has the meaning given to it in Article 5.4.1.2.A below;
“Hyperwallet Payment Solution Provider” means PayPal (Europe) S.à r.l. et Cie, S.C.A.
3. Registration on the Platform and creation of an Account
3.1. Conditions of registration on the Platform
The use of the Platform is reserved for natural persons aged 18 or over. Any registration on the Platform by a minor person is strictly prohibited. By accessing, using or registering on the Platform, you declare and warrant that you are 18 years of age or older.
Please note that BlaBlaCar reserves the right to restrict access to the Platforms located in the European Union to users reasonably identified as being located outside the territory of the European Union.
3.2. Creation of an Account
The Platform allows Members to post Carpooling Adverts and consult Adverts as well as to interact with each other for the booking of a Seat. You may consult the Adverts even if you are not registered on the Platform, and you may make a Bus Booking and a Train Booking. However, you may neither post a Carpooling Advert nor book a Seat in a carpool without first having created an Account and become a Member.
To create your Account, you may:
- either fill in all the mandatory fields appearing on the registration form;
- or log in, via our Platform, to your Facebook account (hereinafter your “Facebook Account”). By using such functionality, you understand that BlaBlaCar will have access to, will publish on the Platform and will retain certain information from your Facebook Account. If you wish to know more about the use of your data within the framework of your Facebook Account, please consult our Privacy Policy and Facebook’s;
- or log in, via our Platform via your iOS App, to your Apple Connect account (hereinafter your “Apple Connect Account”). By using such functionality, you understand that BlaBlaCar will have access to, will publish on the Platform and will retain certain information from your Apple Account. If you wish to know more about the use of your data within the framework of your Apple Account, please consult our Privacy Policy and Apple’s.
In order to register on the Platform, you must have read and accepted these T&Cs.
When creating your Account, regardless of the method chosen to do so, you undertake to provide accurate personal information that is consistent with reality and to update it, via your profile or by notifying BlaBlaCar, in order to guarantee its relevance and accuracy throughout your contractual relationship with BlaBlaCar.
In the case of registration by email, you undertake to keep secret the password chosen when creating your Account and not to communicate it to anyone. In the event of loss or disclosure of your password, you undertake to inform BlaBlaCar without delay. You are solely responsible for the use made of your Account by a third party, for as long as you have not expressly notified BlaBlaCar of the loss, fraudulent use by a third party or disclosure of your password to a third party.
You undertake not to create or use, under your own identity or that of a third party, Accounts other than the one initially created.
(Only applicable in France) You are informed of your right to register on the list of opposition to telephone canvassing if you do not wish to appear on a telephone canvassing list https://www.bloctel.gouv.fr/. This service is governed by the general terms of use and privacy policy of a third party.
3.3. Verification
BlaBlaCar may, for purposes of transparency, improving trust, or preventing or detecting fraud, set up a system for verifying some of the information you provide on your profile. This is particularly the case when you enter your telephone number or provide us with an identity document.
You acknowledge and accept that any reference on the Platform or the Services to information described as “verified” or any similar term, simply means that a Member has successfully completed the verification procedure existing on the Platform or the Services in order to provide you with more information about the Member with whom you are considering travelling. BlaBlaCar does not guarantee the truthfulness, reliability or validity of the information that has been the subject of the verification procedure.
To prevent input errors, you also have the option of verifying your mobile phone number. To do so, you must provide your mobile phone number to BlaBlaCar; you will then receive an SMS containing a 4-digit code that you can validate on the website. This service is free of charge, with the exception of any charges billed by your mobile phone operator.
4. Use of the Services: Carpooling, Bus or Train
4.1. Posting Carpooling Adverts
As a Member, and provided that you meet the conditions below, you may create and post Carpooling Adverts on the Platform by indicating information about the Carpooling Trip you intend to make (dates/times and places of departure and arrival, number of Seats offered, options proposed, amount of the Cost Contribution, etc.).
When posting your Carpooling Advert, you may indicate intermediate cities at which you agree to stop to pick up or drop off Passengers. The sections of the Carpooling Trip between these intermediate cities or between one of these intermediate cities and the point of departure or arrival of the Carpooling Trip constitute “Legs”.
You are only authorised to post a Carpooling Advert if you meet all of the following conditions:
- you hold a valid driving licence;
- you only offer Carpooling Adverts for vehicles of which you are the owner or which you use with the express authorisation of the owner, and in any case which you are authorised to use for carpooling purposes;
- you are and remain the principal driver of the vehicle which is the subject of the Carpooling Advert;
- the vehicle has valid third-party insurance;
- you have no medical contraindication or incapacity to drive;
- the vehicle you intend to use for the Trip is a four-wheeled passenger car (or the local equivalent category), having a maximum of 7 seats, excluding so-called “licence-free” cars;
- you do not intend to post another advert for the same Carpooling Trip on the Platform;
- you do not offer more Seats than those available in your vehicle and/or as authorised by the Platform at the time of posting;
- all the Seats offered have a seat belt, even if the vehicle is approved with seats not equipped with a seat belt;
- you use a vehicle in perfect working order and in compliance with the applicable customs and legal provisions, in particular that it has a current registration and a valid technical inspection (MoT or equivalent), where this is locally required;
- you are a consumer and are not acting in a professional capacity;
- if applicable on the Platform, you have paid the Service Fee for the trip of the previous journey or the Subscription Fees.
You acknowledge that you are solely responsible for the content of the Carpooling Advert you post on the Platform. Consequently, you declare and warrant the accuracy and truthfulness of any information contained in your Carpooling Advert and undertake to make the Carpooling Trip according to the modalities described in your Carpooling Advert.
Your Carpooling Advert will be posted on the Platform and therefore visible to Members and all visitors, including non-Members, who carry out a search on the Platform or on the websites of BlaBlaCar’s partners. BlaBlaCar reserves the right, at its sole discretion, not to post or to remove, at any time, any Carpooling Advert which would not comply with the T&Cs or which it considers to be detrimental to its image, that of the Platform or that of the Services, and/or to suspend the account of the Member who posts such Carpooling Adverts in accordance with Article 9 of these T&Cs.
You are also informed that in the event that you present yourself as a consumer when using the Platform whereas in reality you are acting in a professional capacity, you expose yourself to the sanctions provided for by the regulations in force at the place of the Trip.
4.2. Booking a Seat
BlaBlaCar has set up an online Seat booking system (the “Booking”) for the Trips offered on the Platform.
The booking modalities for a Seat depend on the nature of the planned Trip.
BlaBlaCar makes available to users a search engine accessible on the Platform based on different search criteria (origin, destination, dates, number of travellers, etc.). Some additional functionalities are provided in the search engine when the user logs into their Account. BlaBlaCar invites the user, regardless of the booking method used, to consult and use this search engine conscientiously in order to determine the offer best suited to their needs. If you wish to know more, please consult this link. The Customer making a booking for a Bus Trip at a Point of Sale may also ask the operator or reception agent to perform the search for the Trip.
4.2.1. Carpooling Trip
When a Passenger is interested in a Carpooling Advert, they may make an online Booking request. This Booking request is (i) either accepted automatically (if the Driver has chosen this option when posting their Carpooling Advert), (ii) or accepted manually by the Driver. If applicable on the Booking Platform, the Passenger pays online the amount of the Cost Contribution and/or the relevant Service Fee at the time of the Booking. After verification of the payment by BlaBlaCar and validation of the Booking request by the Driver, where applicable, the Passenger receives a booking confirmation (the “Booking Confirmation”).
If you are a Driver and you have chosen to manage Booking requests yourself when posting your Carpooling Advert, you are required to respond to any Booking request within a certain timeframe. Failing this, the Booking request expires automatically and the Passenger is refunded for all the sums paid at the time of the Booking request, where applicable.
From the Booking Confirmation, BlaBlaCar transmits to you the telephone details of the Driver (if you are a Passenger) or of the Passenger (if you are a Driver), where the Member has given their consent to the disclosure of their telephone number. You are now solely responsible for the performance of the contract binding you to the other Member.
4.2.2. Bus Trip (if available)
In the event that the Platform offers Bus Trips, the following conditions apply.
BlaBlaCar may offer to book a ticket for a given Bus Trip through the Platform.
The Transport Services are then governed by the T&Cs of Sale of the Bus Operator concerned, depending on the Trip selected by the Customer; these T&Cs of Sale must be accepted by the Customer before placing the Order. BlaBlaCar does not provide a transport service in the context of the Bus Trip, the Bus Operators being the sole parties to the T&Cs of Sale. You acknowledge that the booking of Seats for a given Bus Trip is subject to the T&Cs of Sale of the Bus Operator concerned. Following validation of the Order, the Customer receives a Bus Ticket.
BlaBlaCar draws your attention to the fact that some Transport Services offered by Bus Operators and appearing on the website may be cancelled, in particular for climatic reasons, seasonal peaks or in the event of force majeure.
4.2.3. Train Trip (if available)
In the event that the Platform offers Train Trips, the following conditions apply.
BlaBlaCar may offer to book a ticket for a given Train Trip through the Platform.
The Transport Services are then governed by the relevant Train T&Cs of Sale, depending on the Trip selected by the Customer; these Train T&Cs of Sale must be accepted by the Customer before placing the Order. BlaBlaCar does not provide a transport service in the context of the Train Trip, the Rail Operators being the sole parties to the Train T&Cs of Sale. You acknowledge that the booking of Seats for a given Train Trip is subject to the Train T&Cs of Sale of the Rail Operator concerned. Following validation of the Order, the Customer receives a Train Ticket.
BlaBlaCar draws your attention to the fact that some Transport Services and/or some Train Trips offered by Rail Operators and appearing on the website may be cancelled, in particular for climatic reasons, seasonal peaks or in the event of force majeure.
4.2.4. Rights and information of Train Passengers
(Applicable for Trips made within the European Union)
4.2.4.1. General
By virtue of EU Regulation 2021/782, rail Passengers benefit from extended rights and obligations.
All the information listed in Articles 4.2.4.2 to 4.2.4.3 is available in the articles of the Help Centre and in the Train T&Cs of Sale. In the event of any discrepancy between the information contained in the Train T&Cs of Sale and the information contained in the Help Centre, the information of the Train T&Cs of Sale shall prevail.
4.2.4.2. Information before the journey:
In order to be informed about the conditions and modalities listed below, please consult the Train T&Cs of Sale of the relevant rail operators available in the margin, on the right-hand side of these T&Cs:
- Conditions of access for bicycles;
- Disruptions, cancellations, missed connections and delays;
- Availability of facilities on board, including Wi-Fi and toilets, and of services on board, including assistance provided to passengers by staff;
- Procedures for recovering lost luggage.
4.2.4.3. Information specific to disabled persons and persons with reduced mobility:
Contact point for obtaining assistance:
A passenger requiring assistance must inform the relevant Rail Operator at least 24 hours before such assistance is required.
The assistance is provided by the Rail Operators on condition that the Passenger concerned presents themselves at the designated point at the time set by the Rail Operator.

Accessibility conditions:
The accessibility conditions of the station and on board, and of the associated facilities, may be consulted in the Help Centre indicated in Article 16 or on the website of the relevant stations.
Information during the journey:
The passenger may find the following information in the Train T&Cs of Sale of the relevant Rail Operator available in the margin, on the right-hand side of these T&Cs or on their Ticket:
- Services and facilities on board, including Wi-Fi
- Next station
- Disruptions and delays (planned and in real time)
- Main connecting services
- Safety and security matters
4.2.5. Nominative nature of the Seat booking and modalities of use of the Services on behalf of a third party
Any use of the Services, whether as a Passenger or a Driver, is nominative. Both Drivers and Passengers must correspond to the identity communicated to BlaBlaCar and to the other Members participating in the Carpooling Trip, or to the Bus Operator or the Rail Operator, as the case may be.
However, BlaBlaCar allows its Members to book one or more Seats on behalf of a third party. In this case, you undertake to indicate to the Driver or to the Bus Operator or to the Rail Operator, at the time of the Booking, the first name, age and telephone number of the person on whose behalf you are booking a Seat. It is strictly prohibited to book a Seat for a minor travelling alone aged under 13 for a Carpooling Trip. By exception: this limit rises to 16 for a Booking in Italy or Brazil and to 18 for a Booking in Ukraine. In the event that you book a Seat for a Carpooling Trip for a minor travelling alone aged over 13 (or 16 in Italy or Brazil), you undertake to request the prior consent of the Driver and to provide them with an authorisation from the legal representatives duly completed and signed. With regard to a Bus or Train Trip, we invite you to take note of the T&Cs of Sale of the Bus Operator or the Train T&Cs of Sale of the relevant Rail Operator.
In addition, the Platform is intended for the booking of Seats for natural persons. It is therefore prohibited to book a Seat for the transport of an object, package, an animal travelling alone or any material item.
Furthermore, it is prohibited to post a Carpooling Advert for a Driver other than yourself.
4.3. Member Content, moderation and rating system for carpooling
4.3.1. Operation of the carpooling rating system
- Ratings left by Members
BlaBlaCar encourages you to leave a rating about a Driver (if you are a Passenger) or a Passenger (if you are a Driver) with whom you have made a Trip. On the other hand, you are not authorised to leave a rating about another Passenger if you were yourself a Passenger, or about a Member with whom you have not travelled or with whom you were not supposed to travel. Your rating, as well as all ratings left by other Members about you, will only be visible and published on the Platform after the shorter of the following periods: (i) immediately after you have both left a rating, or (ii) 14 days after the publication of the first rating.
- Automatic ratings
In certain situations, BlaBlaCar may automatically publish a rating on your profile:
- Positive rating: If a trip has been confirmed and no Member has left a rating within 14 days, a positive rating (5/5) may be automatically published on the profile of each Member.
- Negative rating: If a Passenger cancels after the deadline, or if a Member reports that the other Member did not show up after a trip, a negative rating (1/5) may be automatically published on the profile of the Member concerned.
- Right of reply
You have a right of reply from the publication of a rating (manual or automatic) left by another user on your profile. The rating and your reply, where applicable, shall be published on your profile.
4.3.2. Moderation
a. Member Content
You acknowledge and accept that BlaBlaCar may, before publication and using automated tools or manually, moderate Member Content as defined in Article 11.2. If BlaBlaCar considers that the Member Content infringes the applicable laws or these T&Cs, it reserves the right to:
- prevent the publication of this Member Content or remove it,
- send a warning to the Member to remind them of the obligation to comply with applicable laws or these T&Cs, and/or
- take restrictive measures in accordance with Article 9 of these T&Cs.
The use, by BlaBlaCar, of these automated tools or manual moderation cannot be interpreted as a commitment to monitor or as an obligation to actively seek out unlawful activities and/or Member Content posted on the Platform and, to the extent permitted by applicable law, cannot engage the liability of BlaBlaCar in any capacity whatsoever.
b. Messages
The exchange of messages between Members via our Platform (“Messages”) is solely intended to share information about Carpooling Trips.
BlaBlaCar may, with the help of automated software and algorithms, detect the content of Messages for the purposes of preventing fraud, improving the service, customer support and performing the contracts entered into with our Members (for example these T&Cs). If, in a Message, content is detected which presents signs of fraudulent or illegal behaviour or of circumvention of the Platform or which is, in any way whatsoever, contrary to these T&Cs:
- this content may not be published,
- the Member who sent this Message may receive a warning to remind them that they are required to comply with the applicable laws or these T&Cs, or
- the Account of this Member may be suspended in accordance with Article 9 of these T&Cs.
The use, by BlaBlaCar, of this automated software cannot be interpreted as a commitment to monitor or as an obligation to actively seek out unlawful activities and/or content on the Platform and, to the extent permitted by applicable law, cannot engage the liability of BlaBlaCar in any capacity whatsoever.
4.3.3. Threshold
In accordance with Article 9 of these T&Cs, BlaBlaCar reserves the right to suspend your Account, limit your access to the Services or terminate these T&Cs in the event that (i) you have received at least three ratings and (ii) the score given to you in a rating or the average of the ratings you have received is equal to or lower than 3, depending on the seriousness of the comments left by a Member in the rating.
4.4. Negotiation by Message (if available)
(Only applicable if negotiation by message is available)
Some Platforms allow the Passenger to propose and grant the Driver an additional financial supplement via the Messaging service for a Carpooling Trip (the “Additional Payment”). In the event that the functionality is available on the Platform, this Additional Payment is intended to share the costs induced by the special request solicited by the Passenger and accepted by the Driver, such as a detour.
This Additional Payment is paid in full to the Driver via the Platform, without the application of a Service Fee by BlaBlaCar.
The amount of the Additional Payment is strictly framed and limited by BlaBlaCar in order to guarantee that the carpooling activity remains a non-professional and non-commercial cost-sharing, in accordance with Article 6 of these T&Cs. If the Driver accepts an Additional Payment(s), this may have the effect of reducing the number of seats offered on the same Trip.
As a Driver, you acknowledge and undertake that the addition of the Additional Payment, combined with the Cost Contribution, does not generate any benefit for your account in respect of the Carpooling Trip. The payment of the Additional Payment shall be made via the Platform under the conditions of Article 5.4.2 of these T&Cs.
In the event of failure to comply with the cap on the Additional Payment set by BlaBlaCar and the conditions of Article 6, you expose yourself to the measures mentioned in Article 9, including the suspension of your Account.
In the event of cancellation, the refund modalities mentioned in Article 7.1 shall apply.
5. Financial conditions
Access to and registration on the Platform, as well as the search for and consultation of Adverts, are free of charge. On the other hand, depending on the Platforms, the posting of Adverts or the Booking may be subject to charges under the conditions described below.
5.1. Cost Contribution and Price
5.1.1. Carpooling: the Cost Contribution
In the context of a Carpooling Trip, the amount of the Cost Contribution is determined by you, as a Driver, under your sole responsibility. It is strictly prohibited to draw the slightest benefit from the use of our Platform. Consequently, you undertake to limit the amount of the Cost Contribution that you ask of your Passengers to the costs that you actually bear for making the Carpooling Trip. Failing this, you alone will bear the risks of reclassification of the operation carried out through the Platform.
When you post a Carpooling Advert, BlaBlaCar suggests an amount of Cost Contribution which takes into account in particular the nature of the Carpooling Trip and the distance travelled. This amount is purely indicative and it is up to you to modify it upwards or downwards to take into account the costs that you actually bear on the Carpooling Trip. In order to avoid abuses, BlaBlaCar limits the possibilities of adjusting the amount of the Cost Contribution.
Depending on the Platform, the payment of the Cost Contribution may be made online under the conditions set out in Article 5.4 below or directly to the Driver on board the vehicle, at the latest at the time of disembarkation, in cash or according to the agreed method.
5.1.2. Carpooling: Service Fee and Subscription (if applicable)
BlaBlaCar may charge, in consideration for the use of the Platform, service fees to its users (hereinafter, the “Service Fee”). The modalities of application and calculation of the Service Fee vary depending on the Platforms and may be applied to the Passenger or the Driver at each booking or in the form of a subscription. The user shall be informed before any application of the Service Fee, where applicable.
5.1.2.1. Service Fee paid by the Passenger (if applicable)
(Only applicable if a Service Fee is requested from the Passenger) In consideration for the use of certain Platforms, BlaBlaCar may apply a Service Fee at the time of the Booking in order to guarantee the proper functioning of the platform, the security of payments and the verification of users.
The amount of the Service Fee varies according to the distance of the Trip, the place of the Trip and the price set by the Driver. It includes VAT and is directly integrated into the total price displayed during your Booking.
The exact amount of the Service Fee is specified separately on the recap page before confirmation of the Booking. The modalities for calculating the Service Fee are provided, for information purposes only, by consulting this link: [SERVICE FEES]
5.1.2.2. Service Fee paid by the Driver (if applicable)
(Only applicable if a Service Fee is requested from the Driver) In consideration for the use of certain Platforms, BlaBlaCar may apply a Service Fee to the Driver for the posting of an Advert. Before posting by the Driver, the latter is informed of the amount and application of the Service Fee, where applicable. This Service Fee shall be invoiced after the realisation of a Trip which has not been the subject of a cancellation.
5.1.2.3. Subscription Fee (if available)
(Only applicable if the Subscription service is offered) In consideration for the use of certain Platforms, BlaBlaCar may invoice Drivers and/or Passengers monthly or annual Subscription Fees instead of the Service Fee. You shall be informed before any application of the Subscription Fees, where applicable.
5.2. Bus and Train: Price of Tickets (if available)
With regard to Bus or Train Trips, the Price per Seat is set at the sole discretion of the Bus Operator or the Rail Operator. The Customer is invited to refer to the relevant T&Cs of Sale in order to take cognisance of the modalities for placing the Order and paying for the Ticket. Concerning the modalities of payment of the Train Ticket, these are available on the Platform at the time of the Order.
BlaBlaCar may charge, when purchasing a Ticket, in consideration for the use of the Platform, service costs. The modalities of application and calculation of the service costs vary depending on the Platforms. The user shall be informed before any application of the service costs, where applicable.
5.3. Rounding
You acknowledge and accept that BlaBlaCar may, at its sole discretion, round the Service Fee and the Cost Contribution down or up to the nearest whole or decimal figure.
5.4. Modalities of online payment of the Cost Contribution to the Driver and of the Price to Bus Operators or Rail Operators
5.4.1. Carpooling
(This section is only applicable in the case where the Platform offers you the possibility of paying the Cost Contribution online)
5.4.1.1. Driver’s instruction mandate
(Only applicable if online payment is offered) By using the Platform as a Driver for Trips, you confirm that you have read and approved the general conditions of the Hyperwallet Payment Solution Provider, our payment service provider which processes the transfers of the Cost Contribution to Drivers via the Hyperwallet Payment Solution as defined in Article 5.4.2.a. These general conditions are referred to below as the “Hyperwallet General Terms”.
For Members who are nationals of the European Union, please note that the exclusions provided for by Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market listed in Article 11.4, points (i) and (ii), of the Hyperwallet General Terms do not apply to Members of the Platform due to their non-professional status.
As a Driver, you give instruction:
- to BlaBlaCar to order the Hyperwallet Payment Solution Provider to make the transfer of the Cost Contribution, and
- to the Hyperwallet Payment Solution Provider to make the transfer of the Cost Contribution to your bank account or your PayPal account in your name and for your account, in accordance with the Hyperwallet General Terms.
In the context of a Carpooling Trip, and after manual or automatic acceptance of the Booking, the entire sum paid by the Passenger (Service Fee and Cost Contribution) is held in a blocked account managed by the Hyperwallet Payment Solution Provider.
5.4.1.2. Payment of the Cost Contribution to the Driver
(Only applicable if online payment is offered) Following the Carpooling Trip, the Passengers have a period of 1 hour to present a complaint to BlaBlaCar. In the absence of any contestation on their part within this period, BlaBlaCar considers the confirmation of the Trip as acquired.
From this express or tacit confirmation, you have, as a Driver, an exigible credit on your Account. This credit corresponds to the total amount paid by the Passenger at the time of confirmation of the Booking, less the Service Fee, that is to say the amount of the Cost Contribution paid by the Passenger.
a. Hyperwallet Payment Solution
The Hyperwallet Payment Solution is a payment service offered by the Hyperwallet Payment Solution Provider. To remove any ambiguity, BlaBlaCar does not provide any payment processing service to Members and is never in possession of the Members’ funds.
When the Carpooling Trip is confirmed by the Passenger, you have the possibility, as a Driver, to receive your Cost Contribution in your bank account or your PayPal account.
To this end, you may use the Hyperwallet Payment Solution by directly entering into a contract with the Hyperwallet Payment Solution Provider and accepting its General Terms.
To receive the first transfer of the Cost Contribution, you will be asked to select a payment method, that is to say to indicate your bank details or to connect your PayPal account, as well as your postal address and your date of birth. Failing this, or if the information you indicate is erroneous, inaccurate or out of date, the Cost Contribution will not be paid to you.
The Transfer shall be made by the Hyperwallet Payment Solution Provider.
At the end of the applicable legal limitation period (3 years in Germany; 5 years in France, the Netherlands and Spain; 6 years in the United Kingdom; 10 years in Belgium and Italy; 20 years in Portugal), any Cost Contribution that you, as a Driver, have not claimed from the date on which it appeared on your Account through the Hyperwallet Payment Solution shall be deemed to be the property of BlaBlaCar.
b. Verifications under Know Your Customer (KYC)
By using the Hyperwallet Payment Solution, you accept to submit to regulatory procedures implemented by the Hyperwallet Payment Solution Provider, subject to its General Terms.
These procedures may include identity checks and any other requirements imposed by the “Know Your Customer” procedure (KYC, for “Know your Customer”) on the basis of criteria defined by the Hyperwallet Payment Solution Provider. These criteria are likely to include financial caps based on the total amount of payments under the Cost Contributions you have received.
For the purposes of the verifications under Know Your Customer, you may be required to provide additional information requested by the Hyperwallet Payment Solution Provider. If you do not communicate the documents thus requested, until your identity has been confirmed, you will not be able to receive the Cost Contribution.
It is possible that, in certain circumstances, the Hyperwallet Payment Solution Provider may, in accordance with applicable laws, have to suspend the transfer of the Cost Contribution or access to the Payment Solution. BlaBlaCar has no control over the acts of the Hyperwallet Payment Solution Provider.
The verifications under Know Your Customer carried out by the Hyperwallet Payment Solution Provider are distinct from and independent of the verifications which BlaBlaCar may carry out within the framework of the use of the Platform in accordance with these Terms and Conditions of Use and the Privacy Policy.
5.4.2. Bus and Train: Payment of the Price of the Ticket (if available)
The payment of any Order made through the Platform is made by one of the means authorised below. The Customer has the option of saving data relating to one or more bank card(s) in their Account in order not to have to systematically enter this information for subsequent payments.
Unless otherwise provided in the Booking process, the means of payment that may be made available are as follows:
- Credit card (the brands accepted are indicated on the Platform. If you have a co-branded card, you may select a specific brand at the payment stage)
- PayPal
- Voucher
- Apple Pay
- Google Pay
- iDEAL
- Oxxo
- Kuponi
- Blik
- Pix
- UPI
No validation of the Order takes place before the actual and full payment of the price of the Transport Services selected by the Customer. If the payment shows an irregularity, is incomplete or is not made for any reason attributable to the Customer, the Order shall be immediately cancelled.
The validation of the Order is materialised by the sending of an email to the Customer recapping the details of the Order.
The Customer is invited to check the settings of their email inbox and in particular to ensure that the validation email is not placed directly among the spam.
The validation of the Order is final. Consequently, any modification shall give rise to either an exchange or a cancellation under the conditions of the applicable T&Cs of Sale. It is the responsibility of the Customer to ensure the appropriate choice of the Transport Services with regard to the needs and expectations of the Passenger. The accuracy of the Personal Information entered by the Customer is the responsibility of the latter, except in the case of a proven failure of BlaBlaCar in the framework of the collection, conservation or protection of this Personal Information.
BlaBlaCar may use network providers to offer and distribute the Tickets as well as their payment service, who shall be responsible for the collection and transfer of the Price of the ticket to the relevant bus operator and, where applicable, of the service costs to BlaBlaCar.
5.5. Financial conditions of Trips located in a third country
When the country of Booking and the country of the Trip are different, it is possible that the Price, the Cost Contribution and the Service Fee (if applicable) be paid in the currency of the country of the Trip to Comuto SA or to any entity of the BlaBlaCar group listed in Article 2. The Passenger shall be informed of the currency set before any confirmation of their Booking.
Consequently, the Passenger accepts the variations linked to exchange rates. Any transaction (payment or refund) may also generate bank charges payable by the Passenger, according to the conditions of their own financial institution.
In this case, refunds (including Vouchers) shall be made in the currency of the country of the Trip. The final amount received may therefore vary depending on exchange rate fluctuations and bank charges.
6. Non-commercial and non-professional purpose of Drivers’ use of the Services and the Platform
You undertake to use the Services and the Platform only to be put in touch, on a non-professional and non-commercial basis, with persons wishing to share a Carpooling Trip with you or to book a Seat in the context of a Bus or Train Trip.
As a Driver, you undertake not to request a Cost Contribution higher than the costs that you actually bear and likely to make you generate a benefit, it being specified that, as it is a sharing of costs, you must also, as a Driver, bear your share of the costs relating to the Carpooling Trip. You are solely responsible for calculating the costs you bear for the Carpooling Trip, and for ensuring that the amount requested from your Passengers does not exceed the costs you actually bear (excluding your share of the Cost Contribution), in particular by referring to the applicable fixed kilometric tax scale.
BlaBlaCar reserves the possibility of suspending your Account in the event that you use a professional vehicle of the VTC or taxi type, a company or service car and thereby generate a benefit on the Platform. You undertake to provide BlaBlaCar, on its simple request, with a copy of the identification document of your vehicle and/or any other document of a nature to attest that you are authorised to use this vehicle on the Platform and do not derive any benefit from it.
In accordance with Article 9 of these T&Cs, BlaBlaCar also reserves the possibility of suspending your Account, limiting your access to the Services or terminating these T&Cs in the event of activity on your part on the Platform which, due to the nature of the trips offered, their frequency, the number of Passengers transported or the amount of the Cost Contribution requested, would lead to a situation of benefit for you or for any reason that would lead BlaBlaCar to suspect that you are generating a benefit on the Platform.
7. Cancellation policy
7.1. Carpooling: Refund modalities in the event of cancellation
Only Carpooling Trips are subject to this cancellation policy, BlaBlaCar offering no guarantee of any nature whatsoever in the event of cancellation, for any reason whatsoever. The refund modalities may vary depending on the Platform.
7.1.1. Cancellation by the Driver
The cancellation of a Seat of a Carpooling Trip by the Driver, in particular when they cancel the Trip after its Confirmation or when they do not turn up at the meeting point at the latest 15 minutes (20 minutes for Italy; 30 minutes for Mexico, Serbia, Turkey or India) after the agreed time, shall result in the Passenger being refunded under the following conditions:
- If the Cost Contribution is made on board the vehicle: The refund of the Service Fee shall take place within 24 hours following the cancellation, only if the Passenger does not manage to book a new Trip within these 24 hours, BlaBlaCar taking into account all the Booking attempts in this period to determine eligibility for a refund.
- If the Cost Contribution is made online: Any cancellation attributable to the Driver shall result in the full and automatic refund of the sum paid online by the Passenger, including the Cost Contribution and the associated Service Fees, regardless of other ongoing reservations.
7.1.2. Cancellation by the Passenger:
- If the Passenger cancels more than 24 hours before the time scheduled for departure as mentioned in the Carpooling Advert, the Passenger shall be refunded the amount of the Cost Contribution and the Additional Payment (where applicable). The Service Fees shall remain acquired by BlaBlaCar and the Driver shall not receive any sum of any nature whatsoever;
- If the Passenger cancels less than 24 hours or 24 hours before the time scheduled for departure, as mentioned in the Carpooling Advert and more than thirty minutes after the Booking Confirmation, the Passenger shall be refunded half of the Cost Contribution paid at the time of the Booking, the Service Fees shall remain acquired by BlaBlaCar and the Driver shall receive 50% of the Cost Contribution as well as the Additional Payment (where applicable) via the Hyperwallet Payment Solution;
- If the Passenger cancels less than 24 hours or 24 hours before the time scheduled for departure, as mentioned in the Carpooling Advert and thirty minutes or less after the Booking Confirmation, the Passenger shall be refunded the entirety of the Cost Contribution and the Additional Payment (where applicable) via the Hyperwallet Payment Solution. The Service Fees shall remain acquired by BlaBlaCar and the Driver shall not receive any sum of any nature whatsoever;
- If the Passenger cancels after the time scheduled for departure, as mentioned in the Advert, or if they do not turn up at the meeting place at the latest within a period of 15 minutes from the agreed time, no refund shall be made. The Driver shall be compensated up to the totality of the Cost Contribution and the Additional Payment (where applicable) via the Hyperwallet Payment Solution and the Service Fees shall be retained by BlaBlaCar.
When the cancellation occurs before departure and through the fault of the Passenger, the Seat(s) cancelled by the Passenger for the said Carpooling Trip shall by full right be made available again to other Passengers who may book them online and consequently subject to the conditions of these T&Cs.
BlaBlaCar appreciates at its sole discretion, on the basis of the elements at its disposal, the legitimacy of the refund requests it receives.
7.2. Bus: Cancellation or exchange policy
The conditions of exchange or cancellation vary from one Bus Operator to another; the conditions are indicated in the Booking process and in the Bus Operators T&Cs of Sale.
7.3. Train: Cancellation or exchange policy
The conditions of exchange or cancellation vary from one Rail Operator to another; the conditions are indicated in the Booking process and in the Rail Operators T&Cs of Sale.
7.4. Information on Withdrawal
The user accepts that the matching service is performed from the Booking Confirmation.
(Only applicable in the European Union) In accordance with the legal provisions in force in the European Union (in particular Article L.221-28 of the French Consumer Code and its European equivalents transposing Directive 2011/83/EU), the user expressly waives their right of withdrawal once the service is fully performed. Furthermore, in accordance with the regulations on passenger transport (e.g.: Art. L.221-2 of the Consumer Code), the right of withdrawal does not apply to transport contracts.
Subject to the specific conditions applicable in the case of Subscription.
7.5. Subscription: Cancellation policies
(Only applicable if the Subscription service is offered) The Subscription may be cancelled at any time using the Contact Form indicated in Article 16. Save for the exception indicated below depending on the option chosen, the cancellation takes effect at the end of the current billing period and the subscription shall remain active until the end of the period paid.
Specific conditions depending on the Subscription chosen:
- Annual subscription: If the Driver subscriber has not made any successful Carpooling Trip as a Driver since the start date of their subscription, they shall receive a full refund and their Subscription shall be terminated immediately. Likewise, if the Passenger subscriber has not made any successful carpooling trip as a Passenger since the start date of their subscription, they shall receive a full refund and their Subscription shall be terminated immediately.
- Monthly subscription: Subscribers have 14 days from the date of subscription to cancel and receive an automatic full refund.
The cancellation rules previously stated do not apply in the event of blocking of the account for non-compliance with the T&Cs; in this eventuality, the subscription shall be terminated without any compensation being due.
8. Behaviour of Platform users and Members
8.1. Commitment of all Platform users
You acknowledge that you are solely responsible for compliance with all the laws, regulations and obligations applicable to your use of the Platform.
Furthermore, when using the Platform and during Trips, you undertake to:
- not use the Platform for professional, commercial or lucrative purposes if you are not a Bus Operator;
- not transmit to BlaBlaCar (in particular when creating or updating your Account) or to other Members or Bus Operators and Rail Operators any false, misleading, untruthful or fraudulent information;
- not make any remarks, have any behaviour or post on the Platform any content (including Messages) of a defamatory, insulting, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, harassing, racist, xenophobic nature, with sexual connotation, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances or, more generally, illegal, contrary to the applicable laws, to these T&Cs or to the purposes of the Platform, of a nature to infringe the rights of BlaBlaCar or a third party or contrary to good morals;
- not infringe the rights and image of BlaBlaCar, in particular its intellectual property rights;
- not open more than one Account and not open an Account in the name of a third party;
- not attempt to circumvent the online booking system of the Platform, in particular by trying to communicate to another Member or a Bus Operator your contact details in order to make the reservation outside the Platform and in particular in order not to pay the Service Fees and/or the Subscription Fees (if applicable on the Platform);
- not contact another Member, in particular through the Platform, for any purpose other than to define the modalities of the carpooling;
- For Platforms offering an online payment, not accept or make a payment outside the Platform or the Hyperwallet Payment Solution;
- comply with these T&Cs;
- For international Trips, each Passenger shall be responsible for the possession of the mandatory travel documents, in particular a valid passport and the required visa, as well as for the payment of the exit tax from the territory if applicable;
- It is strictly prohibited to transport any type of narcotics, intoxicating substances or any other natural or processed substance prohibited by law. Likewise, the transport of bladed weapons and/or firearms is strictly prohibited;
- It is prohibited to spread false information or to usurp the identity of a person other than the one who registered as a User;
- Any behaviour inciting physical, mental or emotional violence, or the commission of a crime or an unlawful act, is prohibited;
- The redistribution of advertisements published on other websites is prohibited, as is the unauthorised publication of content protected by intellectual property laws, such as registered trademarks, copyrights and other information and/or data, without the prior consent of the rights holders;
- It is prohibited to introduce malicious programs (viruses, spyware) or to intercept personal data. The insertion of external links is subject to the express prior authorisation of BlaBlaCar;
- Any attempt to disrupt the operation of the servers or networks linked to the Site is proscribed. Are also prohibited, except by written agreement: “framing”, “mirroring”, as well as any modification, adaptation or reverse engineering of the software and source code;
- Users prohibit themselves from using any device (software or routine) intended to hinder the proper functioning of the Site. In accordance with intellectual property law, any decompilation or translation of the contents and tools of the Site is strictly prohibited.
BLABLACAR reserves the right to report to the competent authorities any behaviour endangering the safety, health and/or life of any person, user or not.
8.2. Drivers’ Commitments
Furthermore, when you use the Platform as a Driver, you undertake to:
- comply with all the laws, rules, codes applicable to driving and to the vehicle in the country of the Trip, in particular to have a valid third-party liability insurance at the time of the Carpooling Trip and to be in possession of a current driving licence;
- ensure that your insurance covers carpooling and that your Passengers are considered as third parties in your vehicle and therefore covered by your insurance;
- not take any risk at the wheel, not consume any product likely to alter your attention and your capacities, drive with vigilance and in complete safety;
- post Carpooling Adverts corresponding only to trips actually planned;
- make the Carpooling Trip as described in the Carpooling Advert (in particular as regards the use or non-use of the motorway) and respect the times and places agreed with the other Members (in particular the meeting and drop-off place);
- not take more Passengers than the number of Seats indicated in the Carpooling Advert;
- use a vehicle in perfect working order and in compliance with the applicable customs and legal provisions, in particular with an up-to-date technical inspection;
- communicate to BlaBlaCar or any Passenger who requests it, your driving licence, your vehicle registration certificate, your insurance certificate, your technical inspection certificate (for example, the MoT Certificate in England, or other equivalent) as well as any document attesting to your ability to use this vehicle as a Driver on the Platform;
- in the event of impediment or change of time or of the Carpooling Trip, inform your Passengers thereof without delay;
- in the event of a cross-border Carpooling Trip, have available and keep at the disposal of the Passenger and any authority that would request it, any document of a nature to justify your identity and your ability to cross the border;
- wait for the Passengers at the agreed meeting place at least 15 minutes (20 minutes for Italy; 30 minutes for Mexico, Serbia, Turkey or India) beyond the agreed time;
- not post a Carpooling Advert relating to a vehicle of which you are not the owner or which you are not authorised to use for carpooling purposes;
- ensure that you are reachable by telephone by your Passengers, on the number registered on your profile;
- if the Platform does not allow online payment of the Cost Contribution, not request payment of the Cost Contribution before the Passenger has been dropped off at their destination, and not request a Cost Contribution amount other than the one indicated when posting the Carpooling Advert;
- not generate any benefit through the Platform;
- guarantee that you have no medical contraindication or incapacity to drive;
- have an appropriate and responsible behaviour, during the Carpooling Trip and in line with the spirit of carpooling;
(Only applicable in India):
- The Driver also undertakes to hold a valid PUC (Pollution Under Control) certificate.
- To take out and maintain a comprehensive insurance to cover civil liability, the Passengers and the Trip. BlaBlaCar understands that the Indian government authorities consider that a passenger travelling by paying only the Cost Contribution is considered as travelling without lucrative purpose for the driver and is consequently considered as a third-party passenger; the Passenger is therefore covered by the Driver’s comprehensive third-party liability insurance. However, BlaBlaCar offers no guarantee in this regard and it is up to the Driver to verify that their insurance offers an adequate coverage.
8.3. Passengers’ Commitments
8.3.1. During a Carpooling Trip
When you use the Platform as a Passenger in the context of a Carpooling Trip, you undertake to:
- adopt an appropriate behaviour during the Carpooling Trip so as not to disturb either the concentration and the driving of the Driver or the tranquillity of the other Passengers;
- respect the Driver’s vehicle and its cleanliness;
- in the event of impediment, inform the Driver thereof without delay;
- wait for the Driver at the agreed meeting place at least 15 minutes (20 minutes for Italy; 30 minutes for Mexico, Serbia, Turkey or India);
- communicate to BlaBlaCar or any Driver who requests it, your identity card or any document of a nature to attest to your identity;
- not transport, during a Carpooling Trip, any object, goods, substance, animal of a nature to disturb the driving and the concentration of the Driver or whose nature, possession or transport is contrary to the legal provisions in force;
- in the event of a cross-border Carpooling Trip, have available and keep at the disposal of the Driver and any authority that would request it, any document of a nature to justify your identity and your ability to cross the border;
- if the Platform does not allow online payment of the Cost Contribution, the Passenger undertakes to pay the Cost Contribution directly to the Driver as agreed on the Carpooling Advert;
- ensure that you are reachable by telephone by the Driver, on the number registered on your profile, in particular at the meeting point.
In the event that you have proceeded to the Booking of one or more Seats on behalf of third parties, in accordance with the stipulations of Article 4.2.5 above, you stand surety for the compliance by this third party with the stipulations of this article and, in general, of these T&Cs. BlaBlaCar reserves the possibility of suspending your Account, limiting your access to the Services or terminating these T&Cs, in the event of breach by the third party on whose behalf you have booked a Seat of these T&Cs, in accordance with Article 9 of these T&Cs.
8.3.2. During a Bus Trip (if available)
In the context of a Bus Trip, the Passenger undertakes to comply with the T&Cs of Sale of the relevant Bus Operator.
8.3.3. During a Train Trip (if available)
In the context of a Train Trip, the Passenger undertakes to comply with the relevant Train T&Cs of Sale.
8.4. Reporting of inappropriate or illegal content (notification and action mechanism)
You may report any suspicious, inappropriate or illegal Member Content or a Message as described on the page “How to report illegal content” of the Help Centre, the link to which is accessible in Article 16.
BlaBlaCar, after having been duly notified in accordance with this Article or by the competent authorities, shall remove as soon as possible any illegal Member Content if:
- this Member Content is manifestly illegal or contrary to the regulations in force; or
- BlaBlaCar considers that this infringes these T&Cs.
If this is the case, BlaBlaCar reserves the right to remove the Member Content which has been duly reported, in a sufficiently detailed and clear manner, and/or to immediately suspend the reported Account.
The Member concerned may contest the decisions of BlaBlaCar referred to above in the manner described in Article 15.2 below.
9. Restrictions on use of the Platform, suspension of accounts, limitation of access and termination
You have the possibility of putting an end to your contractual relationship with BlaBlaCar at any time, free of charge and without reason. To do so, it is sufficient for you to go to the “Account closure” tab of your Profile page.
In the event of (i) breach by you of these T&Cs, in particular of your obligations as a Member mentioned in Articles 6 and 8 above, (ii) exceeding the threshold referred to in Article 4.3.3 above or if (iii) BlaBlaCar has serious reasons to believe that this is necessary to protect its security and integrity, those of its Members or of third parties or for the purposes of investigations or fraud prevention, BlaBlaCar reserves the possibility of:
- terminating, immediately and without notice, these T&Cs; and/or
- preventing the publication of or removing any Member Content; and/or
- limiting your access and use of the Platform; and/or
- suspending your Account temporarily or permanently.
The suspension of the Account may also mean, where applicable, that you will not receive your pending payments.
Where applicable, BlaBlaCar may also send you a warning to remind you that you are required to comply with the applicable laws and/or these T&Cs.
When this is necessary, you shall be notified of the implementation of such a measure in order to allow you to confirm your commitment to comply with these T&Cs and applicable laws, give explanations to BlaBlaCar or contest its decision. BlaBlaCar shall decide, taking into account all the circumstances specific to each case and the seriousness of the infringement, at its sole discretion, whether to lift the measures put in place or not.
10. Personal data
In the framework of your use of the Platform, BlaBlaCar is led to collect and process some of your personal data as described in its Privacy Policy.
11. Intellectual property
11.1. Content published by BlaBlaCar
Subject to the contents provided by its Members, BlaBlaCar is the sole holder of all the intellectual property rights relating to the Service, the Platform, its content (in particular the texts, images, drawings, logos, videos, sounds, data, graphics) as well as the software and databases ensuring their operation.
BlaBlaCar grants you a non-exclusive, personal and non-transferable licence to use the Platform and the Services, for your personal and private use, on a non-commercial basis and in accordance with the purposes of the Platform and the Services.
You prohibit yourself from any other use or exploitation of the Platform and the Services, and of their content, without the prior written authorisation of BlaBlaCar. In particular, you prohibit yourself from:
- reproducing, modifying, adapting, distributing, publicly representing, broadcasting the Platform, the Services and their content, with the exception of what is expressly authorised by BlaBlaCar;
- decompiling, performing reverse engineering of the Platform or the Services, subject to the exceptions provided for by the texts in force;
- extracting or attempting to extract (in particular by using data scraping bots or any other similar data collection tool) a substantial part of the data of the Platform.
11.2. Content published by you on the Platform
In order to allow the provision of the Services and in accordance with the purpose of the Platform, you grant BlaBlaCar a non-exclusive licence to use the contents and data that you provide in the framework of your use of the Services, which may include your Booking requests, your Carpooling Adverts and the comments therein, the biographies, the photos, the ratings and the responses to ratings (hereinafter designated your “Member Content”) and the Messages. In order to allow BlaBlaCar to broadcast through digital network and according to any communication protocol (in particular Internet and mobile network), as well as to make available to the public the content of the Platform, you authorise BlaBlaCar, for the entire world and for the entire duration of your contractual relationship with BlaBlaCar, to reproduce, represent, adapt and translate your Member Content as follows:
- you authorise BlaBlaCar to reproduce all or part of your Member Content on any digital recording medium, known or unknown to date, and in particular on any server, hard drive, memory card, or any other equivalent medium, in any format and by any process known and unknown to date, to the extent necessary for any storage, backup, transmission or download operation linked to the operation of the Platform and the provision of the Service;
- you authorise BlaBlaCar to adapt and translate your Member Content, as well as to reproduce these adaptations on any digital medium, current or future, stipulated in (i) above, for the purpose of providing the Services, in particular in different languages. This right includes in particular the ability to make, in respect of your moral right, modifications to the formatting of your Member Content for the purpose of complying with the graphic charter of the Platform and/or making it technically compatible with a view to its publication via the Platform.
You remain responsible and hold all the rights to the Member Content and Messages that you put online on our Platform.
12. Role of BlaBlaCar
The Platform constitutes an online matching platform on which Members may create and post Carpooling Adverts for Carpooling Trips. These Carpooling Adverts may in particular be consulted by other Members in order to take cognisance of the modalities of the Trip and, where applicable, directly book a Seat in the relevant vehicle from the Member who has posted the advert on the Platform. The Platform also allows the booking of Seats in the context of Bus or Train Trips.
By using the Platform and accepting these T&Cs, you acknowledge that BlaBlaCar is not party to any agreement entered into between you and the other Members for the purpose of sharing the costs relating to a Trip, nor to any agreement entered into between you and a Bus Operator or a Rail Operator.
BlaBlaCar has no control over the behaviour of its Members, the Bus Operators, the Rail Operators and their employees, and the users of the Platform. It does not own, operate, provide, manage the vehicles which are the subject of the Adverts, nor does it offer any Trip on the Platform.
You acknowledge and accept that BlaBlaCar does not control the validity, the truthfulness or the legality of the Adverts, Seats and Trips offered. In its capacity as an intermediary in carpooling, BlaBlaCar does not provide any transport service and does not act as a carrier; the role of BlaBlaCar is limited to facilitating access to the Platform.
In the context of a Carpooling Trip, the Members (Drivers or Passengers) act under their sole and entire responsibility. In its capacity as an intermediary, BlaBlaCar cannot have its liability engaged in respect of the actual conduct of a Trip, in particular due to:
- erroneous information communicated by the Driver or the Bus Operator or the Rail Operator, in their Advert, or by any other means, as to the Trip and its modalities;
- the cancellation or modification of a Trip by a Member or a Bus Operator or a Rail Operator;
- the behaviour of its Members during, before, or after the Trip.
(Only applicable in Turkey)
BlaBlaCar cannot have its liability engaged in respect of the actual conduct of a Trip, except in the case of gross fault as defined in Article 115 of the Turkish Code of Obligations (governing the exclusion of liability).
13. Operation, availability and functionalities of the Platform
BlaBlaCar shall endeavour, as far as possible, to keep the Platform accessible 7 days a week and 24 hours a day. Nevertheless, access to the Platform may be temporarily suspended, without notice, due to technical maintenance, migration, update operations or due to breakdowns or constraints linked to the operation of the networks.
Furthermore, BlaBlaCar reserves the right to modify the Platform or parts of it for certain users in order to test new functionalities and offer a better user experience, as well as to modify or interrupt, at its sole discretion, on a temporary or permanent basis, all or part of the access to the Platform or of its functionalities.
14. Modification of the T&Cs
These T&Cs express the entirety of the agreement between you and BlaBlaCar relating to your use of the Services. Any other document, in particular any mention on the Platform (FAQ, Blog, etc.), has only an informative value.
BlaBlaCar may be led to modify these T&Cs in order to adapt to its technological and commercial environment and in order to comply with the regulations in force. Any modification of these T&Cs shall be published on the Platform with a mention of the date of update and where the law requires it, this modification shall be notified to you by BlaBlaCar before its entry into force.
15. Applicable law and dispute resolution
15.1. Save for mandatory legal provisions to the contrary, these T&Cs are governed by French law. However, as a consumer, you also benefit from the protection afforded to you by the mandatory provisions of the law of your country of habitual residence.
BlaBlaCar and the User undertake to attempt to amicably resolve any disagreement that may arise within the framework of their relationship. Failing amicable resolution, you have the possibility of bringing the matter before the courts of Paris or of your place of habitual residence.
15.2. Internal complaints handling system
You may contest the decisions that we may take regarding:
- the Member Content: for example, if we have removed, restricted the visibility of or refused to remove any Member Content that you provide when using the Platform, or
- your Account: we have suspended your access to the Platform,
if we have taken such decisions because the Member Content is illegal or incompatible with these T&Cs. The contestation procedure is described on the page “How to contest a content removal or an account suspension” of the Help Centre mentioned in Article 16.
(Only applicable in India) BlaBlaCar’s liability for any loss relating to a Trip is capped at INR 1,000. Any claim relating to a Trip must be reported at the latest three months after the end date of that trip. No claim shall be accepted beyond this period.
Given that Drivers are required to hold valid insurance to cover a Trip and given that BlaBlaCar’s service is limited to putting Drivers and Passengers in touch and cannot supervise a Trip, the Members accept that the limitations of BlaBlaCar’s liability set out above are reasonable.
15.3. Out-of-court dispute resolution
(Only applicable in the European Union)
You may also submit, where applicable, your complaints relating to our Platform or our Services, on the dispute resolution platform put online by the European Commission accessible here. The European Commission shall undertake to transmit your complaint to the competent national mediators. In accordance with the rules applicable to mediation, before any request for mediation, you are required to have previously notified BlaBlaCar in writing of any dispute in order to obtain an amicable solution.

18.1. Information relating to the average monthly number of active recipients of the service in the European Union
In accordance with Article 24, paragraph 2, of the regulation of the European Parliament and of the Council on a single market for digital services and amending Directive 2000/31/EC (the “DSA” or “Digital Services Regulation”), providers of online platforms are required to publish information relating to the monthly average of active recipients of the service in the Union, calculated as an average over the last six months. This publication aims to determine whether the provider of an online platform meets the criterion of “very large online platforms” under the DSA, that is to say, whether it exceeds the threshold of 45 million average monthly active recipients in the Union.
February 2026 update: the average monthly number of active recipients of BlaBlaCar in the European Union, calculated over the period of the last six months, from 1 August 2025 to 31 January 2026, in accordance with Article 24(2) of Regulation (EU) 2022/2065 (DSA), was approximately 6.2 million.
This information is solely intended to comply with the requirements of the DSA and must not be used for any other purpose. It shall be updated at least once per semester. The approach we have adopted to perform this calculation may evolve or require modifications over time, for example due to product evolution or the arrival on the market of new technologies.

19. Carbon Credits and Energy Certificates
19.1. Carbon Credits in Brazil
(Only applicable in Brazil and Mexico)
Given the impact of carpooling on the reduction of greenhouse gas emissions, BlaBlaCar may apply for carbon credits (or energy credits/certificates, etc. – hereinafter referred to as “Carbon Credits”) for the carpooling activity carried out through the Platform. By using the Platform and posting a Trip or booking a Seat on a Trip, you irrevocably transfer to BlaBlaCar all the rights and ownership of the Carbon Credits resulting from your Trips made through the Platform. BlaBlaCar has the right to use these Carbon Credits at its sole discretion.
19.2. Bonus under the Energy Saving Certificates (CAE) (only for Spain) – BlaBlaBono Energético
(Only applicable for Carpooling Trips in Spain)
19.2.1. Description of the offer
In the framework of the legislation on Energy Saving Certificates (CAE), BlaBlaCar and Delcae (limited liability company located at Paseo de la Castellana 140, 6ºB, 28046, Madrid, Spain, under NIF B56305618) allow you, if you so wish, to obtain a premium for the energy savings generated during your Carpooling Trips in Spain on the Platform, as a Driver or Passenger. This offer is governed in accordance with the provisions of royal decree 36/2023 of 24 January 2023 establishing a system of Energy Saving Certificates, partially developed by order TED/815/2023 of 18 July 2023 approving a catalogue of standardised energy efficiency measures, the resolution of 8 November 2024 updating Annex I of order TED/845/2023 of 18 July, and any subsequent modification, as well as the specific actions proposed by Delcae and BlaBlaCar (hereinafter referred to as “the regulation of the CAE system”) and is subject to the conditions defined below.
The value of the rewards is calculated on the basis of the energy savings achieved, expressed in kilowatt-hours (kWh). The average redistribution price in 2025 is 0.10 €/kWh.
Subject to the validation of eligibility by the Ministry for Ecological Transition and the Demographic Challenge and compliance with the conditions of the offer, you may receive the premium defined below, according to the modalities of use detailed below:
(i) As a Driver: a payment by bank transfer to your personal account (IBAN or PayPal) registered on your BlaBlaCar profile.
(ii) As a Passenger: a discount applied to your BlaBlaCar user account, usable on the Platform for eligible Trips in Spain within a period of 12 months from the date of issue. Passengers may access information on the discount conditions on the Spanish Platform via the following link. For the trips referred to in Article 19.2.2.3, the conditions shall be published on the Platform after approval by the Ministry for Ecological Transition and the Demographic Challenge.
At its sole discretion, BlaBlaCar may offer additional discounts of limited duration to passengers eligible for the aforementioned premium. The Passengers shall be informed of these discounts, as well as of their value and their period of validity, on the Platform and/or by email and instant messaging. These additional discounts do not affect the existing premium mentioned above. Specific conditions shall apply to these discounts.
BlaBlaCar may modify, suspend or end the reward offer at any time with prior notice. You understand and accept that the existence and validity of the regulation of the CAE system is an essential condition for BlaBlaCar to issue or credit the premium. You accept that in the event of cancellation, invalidity or total or partial disappearance of the regulation of the CAE system, the reward offer shall expire automatically and you shall not be entitled to any reward or credit from BlaBlaCar.
BlaBlaCar may also establish additional conditions for the use of bonuses on the Platform. BlaBlaCar may cancel or set an expiration date for the discounts issued in the following cases:
- The discount is not used in accordance with the conditions of use.
- BlaBlaCar suspects fraudulent or abusive use of the discount.
19.2.2. Conditions of the offer
The conditions of the offer vary depending on the date on which the eligible carpooling trips took place. The offer is valid until 31 December 2027, subject to any update of the regulation of the CAE system (hereinafter the “Validity Period Expiration Date”).
19.2.2.1. Conditions applicable to eligible carpooling trips from 26 February 2026
a. Value of the reward
(i) As a Driver: you are eligible for a bonus for each Booking and for each individual eligible Passenger on a completed eligible Trip. The incentive consists of a payment equal to 15% of the amount paid to you for the Trip, capped at a maximum of 3.5 euros per qualifying Passenger.
(ii) As a Passenger: you may receive an incentive for each Booking of a completed eligible Trip (whatever the number of seats booked). The reward is a discount equal to 15% of the amount you have paid for a Booking, up to a maximum of 3.5 euros.
b. Eligibility conditions
You may benefit from the offer if you meet all the following eligibility conditions (linked to the Member and the Trip):
Eligibility conditions applicable to Members
As a Member, the Driver and the Passenger must meet the following conditions:
- You are registered on the website www.blablacar.es, you have an active Account on the Platform and you have accepted these T&Cs and the Privacy Policy.
- You have a Spanish identity document (DNI/NIE) and your full name corresponds exactly to that indicated on your BlaBlaCar Account.
- You have made an eligible carpooling trip on the Platform between 26 February 2026 and the Validity Period Expiration Date, either as a Driver or as a Passenger.
- You consent to transfer the ownership of the energy savings made during the eligible trips to the BlaBlaCar Platform.
- You have provided or confirmed all the required information at registration: full name, telephone number, type and number of Spanish identity document, registration number (for the Driver), and answer to the survey on alternative modes of transport (for the Passenger).
- You have not requested or received an equivalent premium (CAE) for the same trip from another platform.
Eligibility conditions for the carpooling trips
- The trip takes place on the Platform between 26 February 2026 and the Expiration Date.
- The points of departure and arrival are in Spain. Cross-border trips are not eligible.
- The Driver and the Passenger must activate geolocation on the mobile application and declare the pick-up and drop-off points.
- For trips in the same province, geolocation must remain active throughout the trip.
19.2.2.2. Conditions applicable to eligible carpooling trips from 24 March 2025
The conditions are identical to those of Article 19.2.1, with the following values:
Value of the reward: 10% of the amount paid/received, capped at a maximum of 3 euros per eligible Passenger.
19.2.2.3. Conditional reward offer (19 July 2024 - 23 March 2025)
Subject to approval by the Ministry, the conditions of Article 19.2.2 shall apply to this period.
19.2.3. Verification and validation by authorities
You undertake to respond promptly to any request from BlaBlaCar concerning these conditions. Failing this, the premium may not be paid. The final validation of the energy savings by the National Coordinator is an essential condition for the payment of the premium.
19.3. Carpooling premium in France
(Only applicable in France)
IMPORTANT – Update of 25 June 2024 – the Carpooling Premium operation has ended immediately following the decision of the Council of State to annul the order of 26 September 2022 amending the order of 22 December 2014 defining the standardised energy saving operations insofar as it creates the standardised operation No. TRA-SE-114 relating to long-distance carpooling. As this order was an essential condition of the operation, no premium may be paid from 25 June 2024.

1. GENERAL CONDITION OF USE
1.1 Scope and Definitions
These General Conditions of Use apply to all services provided by BlaBlaCar (defined herein below). BlaBlaCar owns and operates the Site (defined herein below) in India.
Defined Terms
“Additional Payment” has the meaning given to it in Section 2.11. below.
“BlaBlaCar” means Comuto SA, a company registered in France under company number RCS Paris 491904546, and hereafter referred to as Comuto. The registered office of Comuto is at 84 avenue de la République, 75011 Paris, France.
“Car Sharing” means the sharing of a Vehicle for a Trip by a Car Owner carrying a Co-Traveller for that Trip in exchange for a Cost Contribution;
“Conditions” mean these General Conditions of Use, including the Good Conduct Charter and Privacy Policy of BlaBlaCar as notified on the Site.
“Cost Contribution” means the amount agreed between the Car Owner and the Co-Traveler in relation to the Trip which is payable by the Co-Traveler as their contribution towards the costs of the Trip.
“Co-Traveller” or “Passenger” means a Member who has accepted an offer to be transported by a Car Owner and includes all other persons who accompany such Member in the Vehicle for the Trip.
“Car Owner” or “Driver” means a Member who through the Site offers to share a car journey with a Co-Traveller in exchange for the Cost Contribution.
“Member” refers to a registered user of the Site.
“Service” refers to any service provided by BlaBlaCar through the Site to any Member.
“Site” means www.blablacar.co.in, www.blablacar.co.uk, www.blablacar.es, www.blablacar.it, www.blablacar.fr, www.blablacar.nl, www.blablacar.pt,www.blablacar.pl and any other website maintained or operated by BlaBlaCar which offers similar services including any microsites or sub-sites offered through any such website (e.g. “Agenda” and “Campus”).
“Trip” means a given journey in relation to which a Car Owner and a Co-Traveler have agreed upon a transaction through the Site.
“User Account” means an account with the Site opened by a Member and used in order to access the Service provided by BlaBlaCar through the Site.
“Vehicle” means the vehicle offered by a Car Owner for Car Sharing.
1.2 Acceptance of Conditions
The Conditions apply to any and all use of the Site by a Member. By using the Site, the Members signify their acceptance to these Conditions in full and agree to be bound by them .
No access to the Services will be permitted unless the Conditions are accepted in full. No Member is entitled to accept part only of the Conditions. If a Member does not agree to the Conditions, such Member may not use the Services.
All Members agree to comply with the Conditions and accept that their personal data may be processed in accordance with the Privacy Policy.
In the event that any Member fails to comply with any of the Conditions, BlaBlaCar reserves the right, but not the obligation at its own discretion, to withdraw the User Account in question and suspend or withdraw all Services to that Member without notice.
These Conditions are intended to create binding rights and obligations between Members and BlaBlaCar in accordance with the Indian Contract Act, 1872.
1.3 Variation of the Conditions, Site and Service
BlaBlaCar reserves the right to modify the Conditions at any time. In addition, BlaBlaCar may vary or amend the Services provided through the Site, the Site functionality and/ or the “look and feel” of the Site at any time without notice and without liability to Members.
Any modification to the Site, Services or Conditions will take effect as soon as such changes are published on the Site, subject to communication of any material change to the Conditions to the Members in an e-mail.
Members will be deemed to have accepted any varied Conditions in the event that they use any Services offered through the Site following publication of the varied Conditions. Changes will not apply to any bookings which have been made prior to publication of the varied Conditions.
2. USE OF THE SERVICE
2.1 User Account and Accuracy of Information
In order to use the Services each Member must create a User Account and agrees to provide any personal information requested by BlaBlaCar. In particular, Members will be required to provide their first name, last name, age, title, valid telephone number and email address. Use of the Site is limited to those over the age of 18 years at the time of registration.
Members agree and accept that all of the information they provide to BlaBlaCar when setting up their User Account and at any other time shall be true, correct, complete and accurate in all respects. Members also agree that any information supplied to BlaBlaCar or posted on the Site in connection with any Trip, Vehicle or Car Sharing will be true, accurate and complete.
Members agree and understand that BlaBlaCar does not undertake any verification to confirm the accuracy of any information provided by the Members on the Site or to a Car Owner or Co-Traveler, as the case maybe. BlaBlaCar will not be liable to any Member in the event that any information provided by another Member is false, incomplete, inaccurate, misleading or fraudulent.
Unless expressly agreed by BlaBlaCar, Members are limited to one User Account per Member. No User Account may be created on behalf of or in order to impersonate another person.
2.2 No Commercial Activity and Status of BlaBlaCar
The Site and the Services are strictly limited to providing a Service for Car Owners and Co-Travelers to car share in a private capacity. The Services may not be used to offer or accept car sharing for hire or reward or for profit or in any commercial or professional context. The Services may be used only to offer or accept car sharing in exchange for sharing the cost of the Trip between the Car Owner and the Co-Traveler.
Car Owners agree not to obtain any hire or reward or make profit in any form, from any Trip. The Service and the Cost Contribution may only be used to discharge the Car Owner’s costs and may not be used to generate any hiring charges or reward or profit in any form for the Car Owner. The Car Owner is not entitled to make profit by virtue of the amount of the Cost Contribution, the types of Trips offered by a Car Owner, the frequency of such Trips or the number of Co-Travelers transported. This applies to all activities, arrangements and Services booked using the Site and any additional services or activities which may be agreed between Car Owner and Co-Traveler through the Site.
The Car Owner must not provide any additional services to the Co-Traveler in exchange for hiring charges or any reward or for profit or otherwise (and the Co-Traveler may not accept or ask for any such services) including (without limitation) package delivery, waiting time, additional drop offs and pick-ups and collecting additional passengers (other than the Co-Traveler).
All Trips, collection points and destinations must be pre-agreed through the Site between the Car Owner and Co-Traveler. Car Owners may not collect any Co-Travelers from any location which has not been pre-agreed with the Co-Traveler through the Site.
Members are reminded that using the Services and offering Trips for hire or reward or in a commercial or professional capacity may invalidate a Car Owner’s insurance and invite adverse legal actions by the road transport authorities. BlaBlaCar shall not be in for any loss or damage incurred by a Member as a result of any or breach by a Member of these Conditions including where any Car Owner (in breach of these terms) offers Services through the Site in a professional or commercial capacity (thereby potentially invalidating their insurance) and breach of any agreement between the Car Owner and the Co-Traveler. Any offering of Trips in violation of the Conditions shall be at the sole risk such Member and BlaBlaCar shall have no liability towards Members for such violations.
Status of BlaBlaCar
Neither BlaBlaCar nor the Site provides any transport services. The Site is a communications platform for Members to transact with one another. BlaBlaCar does not interfere with Trips, destinations or timings. The agreement for car sharing is between the Car Owner and the Co-Traveler. BlaBlaCar is not a party to any agreement or transaction between Members, nor is BlaBlaCar liable in respect of any matter arising which relates to a booking between Members. BlaBlaCar is not and will not act as an agent for any Member.
Any breach of these Conditions will give rise to immediate suspension of such Member’s User Account and they may be restricted from accessing any further Services.
2.3 Types of Booking and Payment
1. BlaBlaCar offers to its Members an online booking service (hereinafter, the “Booking Service”) with a view to facilitate the booking of seats by Passengers.
BlaBlaCar reserves the right not to offer the Booking Service to a Trip o due to: (i) changes to applicable law, changes in the practice of regulatory authorities or changes in case law, (ii) changes to market practices or technology changes, (iii) changes of business considerations underlying the Booking Services, and (iv) other important and valid reasons
BlaBlaCar reserves the right to limit the number and/or class of Members eligible to the Booking Service for any Trip.
2. How to book a Car-Sharing for a Trip: The Car Owner provides details of his or her Trip on the Site, specifying date and time for departure and destination points, the amount of the Cost Contribution per seat and all other relevant travel conditions.
The Passenger books one or more seats in the car for that Trip from the Site exclusively by clicking on the button « Book » (hereinafter, the “Booking”).
BlaBlaCar will then send an email confirmation to each of the Driver and the Passenger confirming the Booking (hereinafter, the “Booking Confirmation”). Once a Booking Confirmation has been sent, the Booking is complete and a separate binding agreement for Car-Sharing relating to theTrip shall be formed between the Car-Owner and Passenger.
Members accept that given the nature of the service Car Owners and Co-Travelers will have no recourse to BlaBlaCar for any aspect of the transaction including in relation to cancellation, last minute changes, failure by the Car Owner or the Co-Traveler to turn up or non-payment of the Cost Contribution. In particular it is the Car Owner’s responsibility to collect payment from the Co-Traveler at the time of the Trip.
BlaBlaCar will not contact either party and will take no other steps whatsoever than those described above to manage the booking. The operation of the Trip is solely managed by the respective Car Owner and Co-Traveler(s).
Please note that BlaBlaCar reserves the right to change any aspect of the Site or the Service which may include adding new services (which may require payment) or withdrawing any existing Services. BlaBlaCar does not guarantee that the Site will be functional at all times and Services may be suspended during such period when the Site is not in operation. BlaBlaCar will not be liable to any of the Members in case where the Site is non-operational.
2.4 Car Owner and Co-Traveler Obligations
Car Owner's obligations
The Car Owner agrees:
That the Trip shall not be for any fraudulent, unlawful or criminal activity.
That they will procure for the Vehicle, a comprehensive insurance policy, which provides insurance cover to the occupants in the Vehicle and covers third party liability.
That they will present themselves on time and at the place agreed with the specified Vehicle;
That they will immediately inform all Co-Travelers of any change whatsoever to the Trip. If one or more Co-Travelers have made a booking and the Car Owner decides to change any aspect of the Trip, the Car Owner undertakes to contact all Co-Travelers who have made a booking in relation to that Trip and to obtain the agreement of all Co-Travelers to the change. If a Co-Traveler refuses the change, they are entitled to a full refund and without any compensation being paid to the Car Owner.
The Car Owner must comply with the Good Conduct Charter at all times.
The Car Owner must wait for the Co-Traveler at the pickup point for at least 30 minutes after the agreed time (however, the Co-Traveler is expected to be punctual).
Co-Traveler obligations
The Co-Traveler agrees:
That the Trip shall not be for any fraudulent, unlawful or criminal activity.
That they will present themselves on time and at the place agreed with the Car Owner;
That they will immediately inform the Car Owner or BlaBlaCar if they are required to cancel a Trip.
That they will comply with the Good Conduct Charter at all times.
The Co-Traveler agrees to wait at the pickup point for at least 30 minutes after the agreed time for the Car Owner to arrive.
That they will pay the Cost Contribution to the Car Owner.
If the Co-Traveler or Car Owner fail to comply with any of these terms or any other Conditions BlaBlaCar reserves the right to keep information relating to the breach, to publish or disclose this information on the Member’s online profile and to suspend or withdraw the Member’s access to the Site.
That they shall ensure that all other persons who accompany the Co-Traveller in the Trip comply with these Conditions as applicable to a Co-Traveller.
2.5 Insurance
The Car Owner agrees and undertakes to take out and maintain a comprehensive insurance to cover third party liability, the occupants of the Vehicle and the Trip offered or booked through the Site. The Car Owner agrees that they will, on request, provide the Co-Traveler with evidence, in advance of the Trip, of the complete validity of its insurance policy. The Car Owner also undertakes to hold a valid driving licence and that the Car Owner will own or will be entitled to use the Vehicle and that the Vehicle will have a valid PUC (Pollution Under Control) certificate and the Co-Traveler is entitled to request evidence of the Car Owner’s insurance, registration certificate (‘log book’), driving licence and PUC certificate at any time up to completion of the Trip.
It is BlaBlaCar’s understanding that governmental authorities take the view that a Co-Traveler who contributes only towards travel expenses is treated as travelling without hire or reward to the driver, and is therefore a third party passenger who is covered by comprehensive third party insurance policy in India. However BlaBlaCar gives no warranty or assurance in this regard and it is the Car Owner’s responsibility to verify that their insurance provides adequate cover.
It is up to each Car Owner and Co-Traveler to confirm with each other that the Car Owner is covered by valid insurance. The Car Owner must confirm that their insurance policy allows them to carry Co-Travelers and that their insurance policy covers all Co-Travelers and any accident or incident which may occur during a Trip.
The Car Owner and the Co-Traveler are aware that standard non-commercial insurance policies may refuse to cover loss or damage arising in the event that the Car Owner had made or was seeking to make a profit.
The Car Owner may collect no payment from the Co-Traveler other than the Cost Contribution and the Car Owner must not in any event provide Vehicle on hire or for reward in any form.
The Car Owner therefore undertakes to calculate their expenses (fuel, toll, maintenance, repairs, depreciation and insurance of their vehicle) and guarantees that the total Cost Contributions requested from their Co-Travelers does not result in the Vehicle running for hire or for reward.
If the Car Owner does receive any hiring charges or reward, or if the insurers repudiate or refuse to accept any claim arising during a Trip for any other reason, the Car Owner will be responsible for the financial consequences, losses and damages arising and BlaBlaCar will not be liable under any circumstances to the Car Owner or the Co-Traveler.
BlaBlaCar reserves the right, but not the obligation at its own discretion, to suspend immediately the account of a user including the money displayed and to make aware to competent authorities any professional activity.
2.6 Management of Disputes Between Members
BlaBlaCar may at its sole discretion provide its Members with an online service for resolving disputes. This service is non-binding. BlaBlaCar is under no obligation to seek to resolve disputes and this service is offered at BlaBlaCar’s sole discretion and may be withdrawn at any time.
2.7 Verification of IDs and Phone number
By accepting the terms and conditions contained herein, every Member or any person who wishes to register as a Member hereby agrees and consents to the fact that BlaBlaCar may collect IDs / documents belonging to them including but not limited to passport, PAN card and Aadhaar card for the purpose of verification of the information contained in such IDs / documents by third party service providers.
In order to increase trustworthiness, prevent typos and wrong numbers, Member may verify their mobile number. The Member may do this by providing BlaBlaCar with their mobile phone number, after which the Member will receive a SMS with a 4-digit code which can be validated on the Site. This service is free of charge, except for the possible cost levied by a Member’s mobile phone operator for receiving the SMS.
2.8 International Trips and International Bookings
Bookings may be made through the Site for international Trips. An International Trip means any Trip which includes any travel outside of India. If a booking is made for an International Trip Car Owners must ensure that their insurance covers travel outside of India. The Car Owner must also ensure that their vehicle is compliant with all relevant rules and restrictions applicable in any overseas country.
2.9 Messages between Members
BlaBlaCar may review, scan, and moderate the messages the Members exchange with each others through the Site in particular for fraud prevention, customer support purposes, enforcement of the contracts entered into with BlaBlaCar’s members (such as the Conditions) and ensure compliance with applicable law. For example, in order to prevent the circumventing of its Booking Service, BlaBlaCar may scan and analyse messages sent through the platform to check that they do not include any contact details or references to other website.
By using the Site and accepting the T&C’s, the Member agrees that BlaBlaCar, in its sole discretion, may review, analyse and moderate the messages exchanged through the Site.
By using the messaging feature of the Site, the Member undertakes not to write and/or send any message prohibited by applicable law. In particular the Member undertakes to refrain from writting/sending any message which content:
- belongs to another person and to which the Member does not have any right to;
- is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic ;
- harms minors in any way;
- infringes any patent, trademark, copyright or other proprietary rights;
- violates any law for the time being in force;
- deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
- impersonates another person;
- contains software viruses that limit the functionality of any computer resource; and
- threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
In addition, the Member undertakes to send messages only with respect to the booking of Car-sharing and in line with the purposes of this Site. The Member undertakes to refrain from using the messages for private or confidential communications.
BlaBlaCar reserves the right to filter or delete the messages and suspend or terminate the User Account of the Member and the access of the Member to the Site if it appears during the moderation of the messages sent by the Member that s/he does not comply with the Conditions and/or applicable law.
2.10 Contacting Members
By accepting the terms and conditions contained herein, every Member hereby agrees and gives consent to BlaBlaCar to communicate via phone calls, sms, email and such other means as BlaBlaCar may deem fit. Such communications to Members may be recorded through technical support provided by third parties for the purpose of training, quality and for regularly updating the Members about the services of BlaBlaCar.
2.11 Negotiation via Messages
The Site may offer the Co-Traveler the possibility to offer and grant the Car Owner an additional payment via the Messaging service for a Trip (the “Additional Payment”). This Additional Payment is intended to allow a sharing of the costs incurred through a special request made by the Co-Traveler and accepted by the Car Owner, such as a detour.
This Additional Payment is paid in full to the Car Owner together with the Cost Contribution during the Trip.
The amount of the Additional Payment is strictly regulated and limited by BlaBlaCar to ensure that Car Sharing remains a non-professional and non-commercial cost-sharing activity, in accordance with these Conditions. If the Car Owner accepts one or more Additional Payment(s), this may have the effect of reducing the number of seats offered on the same Trip.
As a Car Owner, you recognise and agree that the addition of the Additional Payment, combined with the Cost Contribution, does not generate any profit for you, for the Trip. The payment of the Additional Payment will be made via the Site under the payment conditions established within these Conditions.
In the event of failure to comply with the Additional Payment cap set by BlaBlaCar and the Conditions, you will be subject to the measures mentioned in Section 5.2, including suspension of your User Account.
3. DISCLAIMER OF LIABILITY
3.1 Members may access the Services on the Site at their own risk and using their best and prudent judgment before entering into any arrangements with other Members through the Site. BlaBlaCar will neither be liable nor responsible for any actions or inactions of Members nor any breach of conditions, representations or warranties by the Members. BlaBlaCar hereby expressly disclaims and any and all responsibility and liability in arising out of the use of the Site.
3.2 BlaBlaCar expressly disclaims any warranties or representations (express or implied) in respect of Trips, accuracy, reliability and completeness of information provided by Members, or the content (including details of the Trip and Cost Contribution) on the Site. While BlaBlaCar will take precautions to avoid inaccuracies in content of the Site, all content and information, are provided on an as is where is basis, without warranty of any kind. BlaBlaCar does not implicitly or explicitly support or endorse any of the Members availing Services from the Site.
3.3 BlaBlaCar is not a party to any agreement between a Car Owner and Co-Traveler and will not be liable to either the Car Owner or the Co-Traveler unless the loss or damage incurred arises due to BlaBlaCar’s negligence.
3.4 BlaBlaCar shall not be liable for any loss or damage arising as a result of:
A false, misleading, inaccurate or incomplete information being provided by a Member;
The cancellation of a Trip by a Car Owner or Co-Traveler;
Any failure to make payment of a Cost Contribution (for the free service without booking);
Any fraud, fraudulent misrepresentation or breach of duty or breach of any of these Conditions by a Car Owner or Co-Traveler before, during or after a Trip.
BlaBlaCar will not be liable to any Member for any business, financial or economic loss or for any consequential or indirect loss such as lost reputation, lost bargain, lost profit, lost of anticipated savings or lost opportunity arising as a result of the services provided by BlaBlaCar (whether suffered or incurred as a result of the BlaBlaCar’s negligence or otherwise) except in the case of fraud, wilful concealment or theft.
BlaBlaCar’s liability to any Member for all losses in respect of any Trip is capped at the sum of INR 1,000/- (Indian Rupees One Thousand only).
BlaBlaCar will not be liable to any Member in relation to any Trip unless BlaBlaCar is notified of a claim relating to that Trip within 3 months of completion of the Trip
Given that Car Owners are required to hold valid insurance to cover a Trip and given that BlaBlaCar’s service is limited to putting Car Owners and Co-Travelers in touch with each other and cannot oversee any Trip, Members accept that the limitations on the BlaBlaCar’s liability set out above are reasonable.
4. INDEMNITY AND RELEASE
4.1 Members will indemnify and hold harmless BlaBlaCar, its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Conditions or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.
4.2 Members release BlaBlaCar and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the Members and specifically waiver any claims or demands that they may have in this behalf under any statute, contract or otherwise.
5. GENERAL TERMS
5.1 Relationship
No arrangement between the Members and BlaBlaCar shall constitute or be deemed to constitute an agency, partnership, joint venture or the like between the Members and BlaBlaCar.
5.2 Suspension or Withdrawal of Site Access
In the event of non-compliance on your part with all or some of the Conditions, you acknowledge and accept that BlaBlaCar can at any time, without prior notification, interrupt or suspend, temporarily or permanently, all or part of the service or your access to the Site (including in particular your User Account).
5.3 Intellectual Property
The format and content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of BlaBlaCar, its affiliates or its content suppliers and is protected by India and international copyright, authors' rights and database right laws.
All rights are reserved in relation to any registered and unregistered trademarks (whether owned or licensed to BlaBlaCar) which appear on the Site.
The Site or any portion of the Site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of BlaBlaCar. No person is entitled to systematically extract and/or re-utilise parts of the contents of the Site without the express written consent of BlaBlaCar. In particular, the use of data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site is strictly prohibited.
5.4 Content of the Site Provided by the Members
By displaying content on this Site, Members expressly grant a license to BlaBlaCar to display the content and to use it for any of our other business purposes.
Members of this Site are expressly asked not to publish any defamatory, misleading or offensive content or any content which infringes any other persons intellectual property rights (e.g. copyright). Any such content which is contrary to BlaBlaCar’s policy and BlaBlaCar does not accept liability in respect of such content, and the Member responsible will be personally liable for any damages or other liability arising and agrees to indemnify BlaBlaCar in relation to any liability it may suffer as a result of any such content. However as soon as BlaBlaCar becomes aware of infringing content, BlaBlaCar shall do everything it can to remove such content from the Site as soon as possible.
5.5 Partner Sites
BlaBlaCar reserves the right to reproduce any information that appears on the Site or on the partner sites.
In particular, ads published on one of the sites maintained or co-maintained by BlaBlaCar may be reproduced on other sites maintained or co-maintained by BlaBlaCar or third parties.
6. LAW AND JURISDICTION
These terms shall be governed by the law of India and any disputes arising in relation to these terms shall be subject to the jurisdiction of the Courts of New Delhi.
